Terms and Conditions of Service

1. Acceptance of Terms
EMG Productions, Inc [EMG]., offering services at ePatientHistory.com, ePatientPayments.com and eClientPayments.com provides its service to you [Client] subject to the following terms. By ordering and paying for services, you agree to these terms and conditions.

2. Payment & Cancellation
All fees must be paid in advance of configuration. We accept PayPal, MasterCard, Visa, or company check. No refunds are issued upon cancellation for any reason. Please access our online demos and contact us with any questions prior to ordering services.

Due to the work required to customize and configure your account, and the cost of secure dedicated servers, the cost of services and hosting fees are non refundable if you decide to cancel services for any reason. All plans are for one year periods. At the end of each year, you may renew your account. If you choose not to renew, there will be no charge, your account service will be discontinued, and databases removed from our server.

3. Private Policy
Doctor Registration and patient information data is subject to our privacy policy as follows. EMG does not share client information with any third parties. Only clients have access to their accounts and user data. EMG will not issue client usernames or passwords to any individual other than the client or their designated employee. Clients have the right to purge or retain data records in their online databases. Clients have the right to download the contents of their databases.

4. Registration Policy
In consideration of utilizing ePatientHistory services, you certify that you are of legal age to engage in such a binding contract and have not been barred from receiving these services by an applicable jurisdiction and/or the laws of the United States. You agree to provide complete and accurate information about yourself as required by the ePatientHistory account registration form. If you provide any information that is inaccurate, untrue or incomplete or if EMG has reasonable justification to suspect the same, EMG has the right to suspend or end the agreement and refuse any or all future use of our services without issuing a refund.

5. Access to Client Accounts
Your admin panel username and chosen password will be valid upon initiation of your service. Client is responsible for maintaining the confidentiality of the password and access to the account. Client must ensure proper exit from their account upon completion of each session. Client agrees to immediately notify EMG of any breach of security or any unauthorized used of their username and/or password. EMG, and its subsidiaries, affiliates, officers, partners and agents will be held harmless by client for any loss or damage, claim or demand, including reasonable attorney's fees made by a third party arising from Client's failure to comply with the provisions of section 4 and will assume responsibility for any claims arising therefrom made against EMG.

6. Modification of Service
EMG reserves the right at any time, and from time to time, to modify or discontinue, temporarily or permanently, the Service and prices with or without notice. You agree that EMG will not be liable to you or to any third party for any modification, suspension or discontinuance of the service. Any refunds required upon discontinuance of a service will be issued to clients.

7. EMG Proprietary Rights
You agree and acknowledge that the Service provided by EMG contains proprietary and confidential information that is protected by applicable intellectual property and other laws.

8. Limitation of Liability
You expressly understand and agree the EMG and its subsidiaries, affiliates, officers, partners and agents shall not be liable to you for any direct, indirect, incidental special, consequential or exemplary damages, including , but not limited to, damages from loss of profits, goodwill, use, data or other intangible losses resulting from: (a) the cost of procurement of substitute services; (b) the use or the inability to use the Service; (c) unauthorized access to or alteration of your transmission or data; (d) Statements or conduct of any third party on the Service; or (e) any other matter relating to the Service.
